The Federal Labor Court dismissed the plaintiff's revision against the judgment of the Hessian LAG in an employment case. The parties had waived findings of fact and reasons because of a parallel proceeding. The court therefore only entered the dispositive ruling and ordered the plaintiff to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO; where the parties waive findings of fact and reasons in view of a parallel proceeding, the Federal Labor Court may decide by judgment without a full statement of reasons. If the revision is dismissed, the appellant bears the costs of the revision.

Die Revision des Klägers gegen das Urteil des Hessischen Landesarbeitsgerichts vom 19. November 2012 - 17 Sa 361/12 - wird zurückgewiesen.
Der Kläger hat die Kosten der Revision zu tragen.
