Tenor

  1. Die Anhörungsrüge gegen den Senatsbeschluss vom 11. März 2014 - 1 AZN 1361/13 - wird zurückgewiesen.

  2. Der Kläger hat die Kosten des Rügeverfahrens zu tragen.

  3. Der Wert des Rügeverfahrens wird auf 26.149,84 Euro festgesetzt.

Gründe

1 Die nach § 78a Abs. 2 ArbGG zulässige Rüge ist unbegründet.

2 Der Kläger geht davon aus, sein tatsächliches Vorbringen sei entweder überhaupt nicht zur Kenntnis genommen oder bei der Entscheidung nicht erwogen worden, weil der Beschluss sich nicht mit der Beschwerdebegründung befasse. Das ist unzutreffend. Der Senat hat in seiner Entscheidung vom 11. März 2014 die Angriffe der Nichtzulassungsbeschwerde des Klägers in vollem Umfang geprüft, diese jedoch nicht für durchgreifend erachtet. Die Rüge verkennt, dass es auch von Verfassungs wegen nicht erforderlich ist, alle Einzelpunkte des Parteivorbringens in den Gründen der Entscheidung ausdrücklich zu bescheiden (BVerfG 8. Juli 1997 - 1 BvR 1621/94 - zu B II der Gründe, BVerfGE 96, 205) . Eine mit ordentlichen Rechtsmitteln nicht mehr angreifbare letztinstanzliche Entscheidung bedarf aus rechtsstaatlichen Gründen nicht zwingend einer Begründung (BVerfG 8. Dezember 2010 - 1 BvR 1382/10 - Rn. 12, BVerfGK 18, 301) . Eine Anhörungsrüge gegen die Entscheidung über eine Nichtzulassungsbeschwerde kann auch nicht dazu eingelegt werden, eine Ergänzung der Begründung herbeizuführen*(ebenso zu §§ 321a, 544 Abs. 4 Satz 2 Halbs. 2 ZPO BGH 15. August 2013 - I ZR 91/12 - Rn. 2)* . Ansonsten hätte es eine Partei in der Hand, auf diesem Wege die Regelung des § 72a Abs. 5 Satz 5 ArbGG auszuhebeln (ebenso zu §§ 321a, 544 Abs. 4 Satz 2 Halbs. 2 ZPO BGH 9. April 2013 - IX ZR 100/11 - Rn. 3) .
