The Sixth Senate of the Federal Labour Court dismissed the defendant’s revision against the judgment of the Berlin-Brandenburg Regional Labour Court. The court noted that the parties had waived findings of fact and reasons pursuant to § 313a ZPO. The defendant was ordered to bear the costs of the revision proceedings.
§ 313a ZPO; revision dismissed and costs allocated to the losing party: Where the parties waive the statement of facts and reasons under § 313a ZPO, the appellate judgment may be rendered without further elaboration. If the revision is unsuccessful, it is dismissed and the revision costs are borne by the revising party (consid. tenor).
