Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Frankfurt am Main vom 10. November 2010 - 2 Ca 405/10 - teilweise abgeändert:
Es wird festgestellt, dass das Arbeitsverhältnis zwischen dem Kläger und der Beklagten zu 1. durch die Kündigung vom 24. Dezember 2009 nicht aufgelöst worden ist.
Die Gerichtskosten und die außergerichtlichen Kosten des Klägers in erster Instanz hat der Kläger zu 2/5 und die Beklagte zu 1. zu 3/5, in zweiter Instanz der Kläger zu 1/4 und die Beklagte zu 1. zu 3/4 zu tragen. Die außergerichtlichen Kosten der Beklagten zu 3. in erster und zweiter Instanz hat der Kläger zu tragen. Die Beklagte zu 1. trägt ihre außergerichtlichen Kosten erster und zweiter Instanz selbst.
Die Beklagte zu 1. hat die Kosten der Revision zu tragen.
