Auf die Revision des Beklagten wird das Urteil des Sächsischen Landesarbeitsgerichts vom 24. September 2010 - 3 Sa 80/10 - aufgehoben.

Die Berufung des Klägers gegen das Urteil des Arbeitsgerichts Leipzig vom 17. Dezember 2009 - 1 Ca 2414/09 - wird zurückgewiesen.

Der Kläger hat auch die Kosten der Berufung und Revision zu tragen.
