Omnilex summary

In this employment-law revision, the Federal Labour Court set aside the judgment of the Saxon Labour Court. It then dismissed the plaintiff’s appeal against the Leipzig Labour Court judgment. The court also ordered that the plaintiff bear the costs of both the appeal and revision proceedings. The excerpt indicates that the parties had waived findings of fact and reasons pursuant to the cited procedural provisions.

Omnilex headnote

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; where the parties waive findings of fact and reasons, the judgment may be issued without a full statement of facts and grounds. In such a case, only the operative part and the essential procedural disposition are recorded; the waiver relieves the court from the duty to set out the factual and legal reasoning in full. The revision court may, upon successful revision, set aside the appellate judgment and decide the matter itself by dismissing the appeal and allocating costs accordingly.
