  1. Auf die Revision der Beklagten wird das Urteil des Landesarbeitsgerichts Hamm vom 21. Oktober 2009 - 18 Sa 1423/08 - aufgehoben.

Die Berufung des Klägers gegen das Urteil des Arbeitsgerichts Hagen vom 13. August 2008 - 3 Ca 206/08 - wird zurückgewiesen.
