  1. Auf die Revision der Beklagten wird das Urteil des Landesarbeitsgerichts Hamm vom 3. November 2009 - 14 Sa 264/09 - aufgehoben.

Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Hagen vom 21. August 2008 - 4 Ca 916/08 - wird zurückgewiesen.

  1. Die Klägerin hat auch die Kosten der Berufung und der Revision zu tragen.
