BAG 6 AZR 128/10Bag / Division 6Oct 19, 2010Partially Granted

Omnilex summary

The Federal Labour Court dealt with a wage dispute in which the claimant sought a declaration of entitlement to base salary under pay grade Vb at the highest age step for the period from 1 May 2008 to 31 December 2009. In light of a parallel lead case, the parties waived a full statement of facts and reasons. The court partially set aside the judgment of the Hessian Regional Labour Court and held that the claimant's appeal against the Gießen Labour Court judgment was inadmissible insofar as it concerned that declaratory wage claim. The claimant was ordered to bear the costs of the appeal and revision.

Omnilex headnote

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; waiver of findings and reasons in view of a lead case. Where the parties validly dispense with a full statement of facts and reasons because a parallel leading proceeding is pending, the appellate court may decide in summary form. If the appeal is inadmissible in part, it is to be rejected to that extent; the partial setting aside of the appellate judgment and the allocation of costs follow accordingly. The dispositive effect is limited to the issue actually resolved, without broader merits review.

Key legal question

Whether the claimant's appeal was admissible insofar as it sought a declaration on wage entitlement at the highest age step for a defined period.

Extracted holding

The appeal was dismissed as inadmissible to that extent.

Extracted reasoning

The court partially set aside the appellate judgment and treated the claimant's appeal against the first-instance judgment as inadmissible for the declaratory part concerning payment of base salary at the highest age step for the stated period.

Key legal question

Whether the defendant state's revision should succeed against the appellate judgment.

Extracted holding

The revision succeeded in part, leading to a partial annulment of the appellate judgment.

Extracted reasoning

Because the parties waived a full statement of facts and reasons in view of a parallel lead case, the court decided only the dispositive issue and partially set aside the lower appellate judgment.
