Omnilex summary

The Federal Labour Court partially upheld the defendant state's revision in a BAT remuneration dispute. It set aside the Hessian LAG judgment in part and held that the plaintiff's appeal was inadmissible to the extent it sought a declaration that the state had to pay base salary under Vergütungsgruppe IV b at the highest age step for June to August 2008. The plaintiff was ordered to bear the costs of the appeal and revision. The parties had waived findings of fact and reasons because of the lead parallel case 6 AZR 120/10.

Key legal question

Whether the plaintiff's appeal was admissible insofar as it sought a declaration on pay at the highest age step for June to August 2008.

Extracted holding

The appeal was inadmissible to that extent and had to be dismissed.

Extracted reasoning

The Federal Labour Court partially set aside the appellate judgment and rejected the plaintiff's appeal as inadmissible with respect to the specific declaratory component concerning payment at the highest age step for the relevant period.

Key legal question

Allocation of costs after partial success of the revision.

Extracted holding

The plaintiff must bear the costs of the appeal and revision proceedings.

Extracted reasoning

Because the defendant state's revision succeeded in part and the plaintiff's appeal was rejected in the identified scope, the costs were imposed on the plaintiff.
