Tenor

  1. Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Hamburg vom 12. November 2015 werden als unbegründet verworfen.

  2. Jeder Beschwerdeführer hat die Kosten seines Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Die von der Revision angeregte Vorlage an den Gerichtshof der Europäischen Union gemäß Art. 267 AEUV ist nicht veranlasst.

Die Auslegung des Begriffs der Uneinbringlichkeit i.S.v. § 17 Abs. 2 Nr. 1 UStG durch die Strafkammer (vgl. hierzu auch die Stellungnahme des Generalbundesanwalts) entspricht der ständigen Rechtsprechung des Bundesfinanzhofs zur Unzulässigkeit eines Vorsteuerabzugs gemäß § 15 Abs. 1 UStG, wenn schon zurzeit der Rechnungsstellung Uneinbringlichkeit gegeben ist (vgl. BFH, Urteil vom 24. Oktober 2013 – V R 31/12, BFHE 243, 451, BStBl II 2015, 674; Beschluss vom 9. April 2014 – XI B 10/14, BFH/NV 2014, 1099).

Bei der Auslegung des Begriffs der Uneinbringlichkeit steht den Mitgliedstaaten ein Regelungsspielraum zu (vgl. Art. 90 Abs. 1 und 2 der Richtlinie 2006/112/EG des Rates vom 28. November 2006 über das gemeinsame Mehrwertsteuersystem – MwStSystRL). Die Annahme einer Uneinbringlichkeit aufgrund von Umständen, die vor Einreichen der Umsatzsteuervoranmeldungen gegeben waren, verstößt im Hinblick auf diese den Mitgliedstaaten eingeräumte Regelungsbefugnis nicht gegen den durch Art. 90 MwStSystRL vorgegebenen Rechtsrahmen (BFHE 243, 451 aaO). Dieses Auslegungsergebnis unterliegt keinen vernünftigen Zweifeln.
