Omnilex summary

The Federal Court of Justice rejected the defendants’ revisions against the judgment of the Regional Court of Schwerin as unfounded. It ordered each appellant to bear the costs of the remedy. In an additional remark, the court clarified that an incorrect trade tax assessment, like an incorrect profit determination notice under § 180 AO or an excessive carryforward trade loss under § 10a GewStG, can amount to an unjustified tax advantage under § 370(1) AO.
