Tenor

Die Nichtzulassungsbeschwerde der Kläger gegen den Beschluss des 14. Zivilsenats des Oberlandesgerichts Karlsruhe vom 14. Juli 2015 wird zurückgewiesen, weil die Rechtssache keine grundsätzliche Bedeutung hat und die Fortbildung des Rechts sowie die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts nicht erfordern (§ 543 Abs. 2 Satz 1 ZPO). Von einer näheren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen.

Bei einer unechten Abschnittsfinanzierung steht einem Verbraucher kein Widerrufsrecht nach den Vorschriften über Verbraucherdarlehensverträge gemäß § 495 Abs. 1, § 355 BGB zu, wenn nach Auslaufen der Zinsbindungsfrist mit der darlehensgebenden Bank lediglich neue Konditionen für die Zukunft vereinbart werden und die Konditionenanpassung entsprechend dem ursprünglich geschlossenen Darlehensvertrag vollzogen wird (Senatsurteil vom 28. Mai 2013 - XI ZR 6/12, WM 2013, 1314 Rn. 22). Das ist auch bei einer - hier als Forward-Darlehen bezeichneten - zeitlich vorgezogenen Neuregelung des Zins- und Tilgungsanteils der Darlehensraten der Fall, wenn dem Darlehensnehmer damit kein neues Kapitalnutzungsrecht eingeräumt wird.

Die Kläger tragen die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis zu 125.000 €.
