  1. Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Erfurt vom 6. Juli 2015 werden als unbegründet verworfen – das Rechtsmittel des Angeklagten W. im Hinblick auf ein offensichtliches Schreibversehen mit der Maßgabe, dass dieser zu einer Gesamtfreiheitsstrafe von vier Jahren verurteilt ist –, weil die Nachprüfung aufgrund der Revisionsrechtfertigungen keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat.

Ergänzend bemerkt der Senat:

Soweit der Beschwerdeführer W. zutreffend beanstandet, dass in den Urteilsgründen Vorgeschichte, Tatschilderung, nicht verfahrensgegenständliche strafbare Handlungen und Beweiswürdigung vermischt seien, teilt der Senat die Auffassung des Generalbundesanwalts, dass sich diese Unübersichtlichkeit auf den Schuld- und Strafausspruch nicht ausgewirkt hat.

Die Urteilsgründe müssen so abgefasst werden, dass sie erkennen lassen, welche der festgestellten Tatsachen den objektiven und subjektiven Tatbestandsmerkmalen der abgeurteilten Taten zuzuordnen sind und diese ausfüllen können (vgl. Meyer-Goßner/Appl, Die Urteile in Strafsachen, 29. Aufl., Rn. 281 ff.). Hier ist den Gründen einschließlich der rechtlichen Würdigung im Gesamtzusammenhang noch hinreichend zu entnehmen, welche Handlungen als Straftaten der Angeklagten abgeurteilt sind.

Die Urteilsgründe haben jedoch nicht die Aufgabe, jede Einzelheit des Rahmengeschehens darzustellen. Die Wiedergabe von zahlreichen nebensächlichen Details ohne erkennbare Entscheidungserheblichkeit macht die Urteilsgründe unübersichtlich, fehleranfällig und führt zu unnötiger Schreib- und Lesearbeit. § 267 Abs. 1 StPO erfordert auch nicht die Dokumentation aller in der Hauptverhandlung erhobenen Beweise, sondern nur der wesentlichen Beweisergebnisse und ihrer Würdigung durch das Tatgericht (vgl. BGH, Beschluss vom 9. April 1999 – 3 StR 54/99; Appl in Festschrift für Rissing-van Saan, 2011, S. 35, 45). Die Urteilsgründe sollen alles Wesentliche enthalten, aber nicht mehr als dies. Für ihre sachgerechte Abfassung tragen die Berufsrichter der Strafkammer die Gesamtverantwortung.
