  1. Auf die Revision der Angeklagten wird das Urteil des Landgerichts Krefeld vom 2. Oktober 2014

a) aufgehoben, soweit die Angeklagte im Fall B.II.9. der Urteilsgründe wegen Steuerhinterziehung verurteilt worden ist; insoweit wird das Verfahren eingestellt; im Umfang der Einstellung fallen die Kosten des Verfahrens und die notwendigen Auslagen der Angeklagten der Staatskasse zur Last;

b) im Schuldspruch dahin geändert, dass die Angeklagte der Steuerhinterziehung in 14 Fällen schuldig ist.

  1. Die weitergehende Revision wird verworfen.

  2. Die verbleibenden Kosten des Rechtsmittels trägt die Angeklagte.

Gründe

1 Das Landgericht hat die Angeklagte wegen Steuerhinterziehung in 15 Fällen unter Einbeziehung der Strafen aus dem Urteil des Amtsgerichts Krefeld vom 21. Januar 2013 (Az. ) zu einer Gesamtfreiheitsstrafe von drei Jahren und sechs Monaten verurteilt. Hiergegen richtet sich die mit der Sachrüge begründete Revision der Angeklagten.

2 Das Rechtsmittel hat den aus der Entscheidungsformel ersichtlichen Teilerfolg (§ 349 Abs. 4 StPO); im Übrigen ist es unbegründet im Sinne des § 349 Abs. 2 StPO.

3 Soweit die Angeklagte im Fall B.II.9. der Urteilsgründe wegen Steuerhinterziehung (§ 370 Abs. 1 Nr. 2 AO) verurteilt wurde, stellt der Senat das Verfahren nach § 206a Abs. 1 StPO wegen eines Verfahrenshindernisses ein. Die festgestellte Straftat ist verjährt. Die für die Steuerhinterziehung gemäß § 370 Abs. 1 Nr. 2 AO maßgebliche fünfjährige Verjährungsfrist (§ 78 Abs. 3 Nr. 4 StGB) begann mit Ablauf des 31. Mai 2006 zu laufen. Die Tat war zu diesem Zeitpunkt, zu dem die Umsatzsteuererklärung für das Jahr 2005 spätestens abzugeben war (§ 18 Abs. 3 UStG, § 149 Abs. 2 AO), im Sinne des § 78a StGB beendet. Eine Unterbrechung der Verjährung trat vor Fristablauf nicht ein; ein Anwendungsfall des § 376 Abs. 1 AO i.V.m. Art. 97 § 23 EGAO ist nicht gegeben. Mit Ablauf der Verjährungsfrist am 31. Mai 2011 ist deshalb ein Verfahrenshindernis eingetreten, welches insoweit die Einstellung des Verfahrens gemäß § 206a Abs. 1 StPO zur Folge hat.

4 Durch den Wegfall einer Einzelstrafe von zehn Monaten in Folge der Teileinstellung des Verfahrens wird der Bestand des Gesamtstrafenausspruchs nicht in Frage gestellt. Mit Blick auf die verbleibenden 98 Einzelstrafen, darunter zahlreiche Freiheitsstrafen von sechs Monaten bis zu einem Jahr und drei Monaten, kann der Senat ausschließen, dass die Strafkammer ohne den eingestellten Fall auf eine niedrigere Gesamtfreiheitsstrafe erkannt hätte.
