Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hanau vom 23. März 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die den Nebenklägern im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Die tatrichterliche Erwägung, der Angeklagte habe sich „das in hiesiger Sache laufende Ermittlungsverfahren" nicht „zur Warnung dienen lassen, sondern am 01.10.2012 erneut eine Körperverletzung begangen", versteht der Senat unter Berücksichtigung des Gesamtzusammenhangs der Urteilsgründe dahin, dass der Tatrichter dem Umstand, dass der Angeklagte trotz des gegen ihn anhängigen Ermittlungsverfahrens in vorliegender Sache eine neuerliche und einschlägige Straftat begangen hat, Indizwirkung für seine fehlende Rechtstreue beigemessen hat. Dies dient der zutreffenden Erfassung der Täterpersönlichkeit und ist daher - ungeachtet des missverständlichen Hinweises auf die „Warnwirkung" des anhängigen Verfahrens, die allein in dem wegen der späteren Tat geführten Strafverfahren zu seinen Ungunsten berücksichtigt werden kann - rechtlich unbedenklich (vgl. BGH, Beschluss vom 5. Februar 1998 - 4 StR 16/98, NStZ 1998, 404; Senat, Urteil vom 30. September 2009 - 2 StR 270/09, NStZ-RR 2010, 40; Fischer StGB, 62. Aufl., § 46 Rn. 38).
