Die Beschwerde gegen die Nichtzulassung der Revision im Urteil des 5. Zivilsenats des Oberlandesgerichts Naumburg vom 28. Januar 2015 wird auf Kosten des beklagten Landes zurückgewiesen.

Der Streitwert wird auf 194.373,61 € festgesetzt.

Gründe

1 Die Beschwerde deckt keinen Zulassungsgrund auf.

2 1. Die angefochtenen Zahlungen der Schuldnerin haben entgegen der Auffassung des Beklagten eine Gläubigerbenachteiligung (§ 129 Abs. 1 InsO) ausgelöst. Die Begleichung der Umsatzsteuer kann nach ständiger Rechtsprechung des Bundesgerichtshofs gegenüber dem Finanzamt als eine gläubigerbenachteiligende Leistung angefochten werden (vgl. nur BGH, Urteil vom 19. Januar 2012 - IX ZR 2/11, BGHZ 192, 221; vom 24. Mai 2012 - IX ZR 125/11, WM 2012, 1208). Gleiches gilt bei Zahlungen von Arbeitgebern auf die von den Arbeitnehmern geschuldete Lohnsteuer (vgl. nur BGH, Urteil vom 22. Januar 2004 - IX ZR 39/03, BGHZ 157, 350, 358; vom 9. Dezember 2004 - IX ZR 108/04, BGHZ 161, 315, 317). Die von der Beschwerde geltend gemachten Erwägungen geben keinen Anlass, von dieser Bewertung abzugehen.

3 2. Die weiteren Rügen hat der Senat geprüft. Sie sind nicht begründet.
