Tenor

Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Düsseldorf vom 16. Oktober 2014 werden als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigungen keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Jeder Beschwerdeführer hat die Kosten seines Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Zwar hat es das Landgericht im Rahmen der Prüfung, ob jeweils ein minder schwerer Fall nach § 244 Abs. 3 StPO vorliegt, versäumt, bei den vier Fällen des versuchten Wohnungseinbruchdiebstahls in die erforderliche Gesamtabwägung neben die für sich nicht ausreichenden allgemeinen Strafmilderungsgründe auch den gesetzlich vertypten Milderungsgrund der § 23 Abs. 2, § 49 Abs. 1 StGB einzustellen (vgl. BGH, Beschluss vom 8. Juli 2014 - 3 StR 276/14, juris Rn. 4). Dies gefährdet den Bestand des Urteils vorliegend jedoch nicht. Hinsichtlich des Angeklagten G. hat sich das Landgericht bei der Bestimmung der Einzelstrafen ersichtlich am unteren Ende des herangezogenen Strafrahmens orientiert. Daher erweist sich der nach § 23 Abs. 2, § 49 Abs. 1 StGB gemilderte Strafrahmen des § 244 StGB (1 Monat bis 7 Jahre 6 Monate) für die Bemessung der vier Einzelstrafen gegenüber dem des minder schweren Falls (3 Monate bis 5 Jahre) als günstiger. Bezüglich des Angeklagten K. schließt der Senat angesichts der rechtsfehlerfrei herangezogenen strafschärfenden Gesichtspunkte (u.a. einschlägige Vorstrafe, Bewährungsbruch) aus, dass das Landgericht bei Berücksichtigung des gesetzlich vertypten Milderungsgrundes auf einen minder schweren Fall erkannt hätte (§ 337 StPO).
