Omnilex summary

The Federal Court of Justice rejected the defendant’s revision against a judgment of the Regional Court of Braunschweig. The Senate held that, for § 95(3) No. 1a AMG, the health of a large number of people is endangered where 20 persons are affected. It also found no basis for lesser-case treatment in counts 22–26, 28, 30 and 31, nor for excluding the ordinary sentencing range in counts 3–21, given the scope and gravity of the offenses. The defendant was ordered to bear the costs of the remedy.

Omnilex headnote

§ 95 Abs. 3 Nr. 1 Buchst. a AMG; health endangerment of a large number of people. A danger to the health of a large number of persons is present, as a rule, when 20 persons are affected (consid. 2). The assessment of lesser cases and the exclusion of the ordinary sentencing range depend on the scope and weight of the offenses; where these are substantial, appellate interference is not warranted absent legal error (consid. 3).

Entscheidungsdatum: 2015-01-27

Aktenzeichen: 5 StR 549/14

Dokumenttyp: Beschluss

Normen: § 95 Abs 3 Nr 1 Buchst a AMG

Vorinstanz: vorgehend LG Braunschweig, 10. Juli 2014, Az: 8 KLs 48/13

Spruchkörper: 5. Strafsenat

Titelzeile

Gesundheitsgefährdung einer großen Zahl von Menschen

Tenor

Extracted by Omnilex

Key legal question

Whether the defendant’s revision against the Braunschweig judgment was well-founded.

Extracted holding

The revision was unfounded and therefore rejected.

Extracted reasoning

The Senate found no reversible legal error in the conviction or sentence.

Key legal question

Whether the threshold of endangering the health of a large number of people under § 95(3) No. 1a AMG was met.

Extracted holding

Yes; the court held that at least 20 affected persons satisfy the requirement.

Extracted reasoning

The Senate expressly approved the lower court’s view that the statutory aggravating circumstance is present when 20 persons are affected.

Key legal question

Whether lesser cases or the ordinary sentencing range should have been applied in the charged counts.

Extracted holding

No; the assumption of lesser cases was far removed, and use of the normal sentencing range was not excluded.

Extracted reasoning

Given the scope and weight of the offenses, the lower court was entitled to reject both the lesser-case treatment and any departure from the ordinary sentencing range.
