Tenor

Die Rechtsbeschwerde gegen den Beschluss der 9. Zivilkammer des Landgerichts Erfurt vom 27. April 2014 wird auf Kosten der Beklagten als unzulässig verworfen.

Der Gegenstandswert des Rechtsbeschwerdeverfahrens beträgt 476 €.

Gründe

1 Die Parteien sind Grundstücksnachbarn. Das Amtsgericht hat die Beklagten verurteilt, die auf ihrem Grundstück unmittelbar an der gemeinsamen Grundstücksgrenze befindliche ca. 3,50 m breite, 2,60 m hohe und 85 cm tiefe Holzkonstruktion zu beseitigen und im Falle einer Neuerrichtung einen Abstand von 1,10 m zur Grundstücksgrenze einzuhalten. Das Landgericht hat die Berufung als unzulässig verworfen. Dagegen wenden sich die Beklagten mit der Rechtsbeschwerde.

2 Nach Ansicht des Berufungsgerichts ist die Berufung unzulässig, weil die Beschwer der Beklagten 600 € nicht übersteige (§ 511 Abs. 2 Nr. 1 ZPO). Maßgeblich für die Bemessung der Beschwer seien die Kosten des Rückbaus des Holzregals, nicht dagegen die Kosten einer Neumontage an anderer Stelle.

3 Die Rechtsbeschwerde ist gemäß § 522 Abs. 1 Satz 4, § 574 Abs. 1 Satz 1 Nr. 1 ZPO statthaft. Sie ist aber unzulässig. Die Sache hat weder grundsätzliche Bedeutung noch liegt der Zulassungsgrund der Fortbildung des Rechts vor. Es ist in der Rechtsprechung des Senats geklärt, dass sich der Wert der Beschwer des zur Beseitigung eines Bauwerks verurteilten Beklagten grundsätzlich nach den Kosten einer Ersatzvornahme des Abrisses bemisst, die ihm im Falle des Unterliegens drohen (Urteil vom 10. Dezember 1993 - V ZR 168/92, BGHZ 124, 313, 319; Senat, Beschluss vom 29. Januar 2009 - V ZR 152/08, Grundeigentum 2009, 514; Beschluss vom 10. April 2014 - V ZB 168/13, Rn. 7, juris). Hiervon geht auch das Berufungsgericht aus. Diese Kosten sind in der Berufungsinstanz von den Beklagten mit 476 € angegeben worden.

4 Auf die von der Rechtsbeschwerde aufgeworfene Frage, ob für die Bemessung der Beschwer auch das Interesse der Beklagten am Erhalt des Holzregales zu berücksichtigen ist (vgl. Senat, Beschluss vom 29. Januar 2009 - V ZR 152/08, Grundeigentum 2009, 514), kommt es nicht an. Denn es ist weder vorgetragen noch sonst ersichtlich, dass die Beklagten ein über das Interesse an der Abwehr der Kosten einer Beseitigung hinausgehendes Interesse am Verbleib des Holzregals an seinem bisherigen Standort haben.

5 Die mit einer Wiedererrichtung des Holzregals an anderer Stelle verbundenen Kosten sind unmaßgeblich. Als lediglich mittelbare wirtschaftliche Folge der Verurteilung bleiben sie bei der Bemessung der Beschwer außer Betracht (vgl. Senat, Beschluss vom 26. Juni 2008 - V ZR 155/07, juris; Beschluss vom 6. November 2014 - V ZR 11/14 Rn. 4, juris).

IV.

6 Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
