Auf die Beschwerde der Beklagten wird die Entscheidung des Hessischen Verwaltungsgerichtshofs über die Nichtzulassung der Revision gegen sein Urteil vom 3. September 2013 aufgehoben.

Die Revision wird zugelassen.

Die Entscheidung über die Kosten des Beschwerdeverfahrens folgt der Kostenentscheidung in der Hauptsache.

Der Wert des Streitgegenstandes wird für das Revisionsverfahren vorläufig auf 580 000 € festgesetzt.

Gründe

1 Die Beschwerde ist begründet. Die Revision ist wegen grundsätzlicher Bedeutung der Sache zuzulassen. Das Revisionsverfahren bietet voraussichtlich Gelegenheit zur Klärung der Rechtsfrage, ob die Festlegung von Flugverfahren, mit denen eine Abwicklung des vom Planfeststellungsbeschluss vorgegebenen Verkehrsvolumens in absehbarer Zeit nicht erreichbar ist, rechtswidrig ist und Gemeinden oder private Lärmbetroffene in ihren Rechten verletzt.

2 Die vorläufige Festsetzung des Streitwerts für das Revisionsverfahren beruht auf § 47 Abs. 1 Satz 1, Abs. 3, § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
