Gründe

1 Die Gläubigerin erteilte dem Gerichtsvollzieher am 5. September 2013 unter Übergabe der vollstreckbaren Ausfertigung des Vollstreckungstitels wegen einer Hauptforderung in Höhe von 1.100,89 € einen Auftrag zur Vollstreckung und zur Ermittlung des Aufenthaltsorts des Schuldners. Der Gerichtsvollzieher lehnte ein Tätigwerden unter Hinweis darauf ab, dass in dem Vollstreckungsauftrag die vorzunehmende Vollstreckungsmaßnahme entsprechend den in § 802a Abs. 2 ZPO aufgeführten Regelmaßnahmen nicht bezeichnet sei. Die Gläubigerin vertritt die Auffassung, der Gerichtsvollzieher sei verpflichtet, aufgrund des Vollstreckungsauftrags den Aufenthaltsort des Schuldners zu ermitteln, bevor sie konkrete Maßnahmen zur Vollstreckung im Sinne von § 802a Abs. 2 Satz 1 ZPO bezeichnet.

2 Das Amtsgericht hat die dagegen gerichtete Erinnerung der Gläubigerin zurückgewiesen. Die sofortige Beschwerde der Gläubigerin ist erfolglos geblieben. Mit der vom Beschwerdegericht zugelassenen Rechtsbeschwerde hat die Gläubigerin zunächst ihren Antrag weiterverfolgt. Nachdem die Anschrift des Schuldners noch im Beschwerdeverfahren ermittelt werden konnte, hat die Gläubigerin, die hiervon erst im Rechtsbeschwerdeverfahren Kenntnis erhalten hat, das Verfahren in der Hauptsache für erledigt erklärt. Der Schuldner hat der Erledigungserklärung innerhalb der ihm entsprechend § 91a Abs. 1 Satz 2 ZPO gesetzten Notfrist von zwei Wochen nicht widersprochen.

3 Nach übereinstimmender Erledigung des Verfahrens in der Hauptsache ist über die Kosten des Verfahrens insgesamt gemäß § 91a Abs. 1 ZPO nach dem bisherigen Sach- und Streitstand sowie nach billigem Ermessen zu entscheiden. Danach sind die Kosten des Verfahrens der Gläubigerin aufzuerlegen, weil ihr Rechtsmittel in der Sache keinen Erfolg gehabt hätte. Der Senat nimmt insoweit auf die im Wesentlichen zutreffenden Gründe des angefochtenen Beschlusses (LG Heidelberg, DGVZ 2014, 93) Bezug.

4 Die Gerichtskosten des Rechtsbeschwerdeverfahrens werden nicht erhoben, § 21 GKG, weil bereits vor der Beschwerdeentscheidung der Aufenthaltsort des Schuldners dem Gericht bekannt geworden und der Gläubigerin nicht mitgeteilt worden ist.
