Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 4. Zivilsenats des Pfälzischen Oberlandesgerichts Zweibrücken vom 6. Dezember 2012 wird auf Kosten der Beklagten zurückgewiesen.

Der Wert des Verfahrens der Nichtzulassungsbeschwerde wird auf 30.183,88 € festgesetzt.

Gründe

1 Die Rechtssache hat keine grundsätzliche Bedeutung, und weder die Fortbildung des Rechts noch die Sicherung einer einheitlichen Rechtsprechung erfordert eine Entscheidung des Revisionsgerichts (§ 543 Abs. 2 ZPO).

2 Hinsichtlich der Frage, unter welchen tatsächlichen Voraussetzungen ein Wohnsitz im Sinne von § 7 Abs. 3 BGB aufgehoben wird, hat sich das Berufungsgericht an der Rechtsprechung des Bundesgerichtshofs orientiert (vgl. BGH, Beschluss vom 22. Oktober 2009 - IX ZB 248/08, WM 2010, 683 Rn. 18). Es hat sich durch Vernehmung der Zeugin K. , einer Nachbarin, die Überzeugung verschafft, dass der Wohnsitz der Beklagten in W. im Zeitpunkt der Zustellung des Versäumnisurteils am 16. Dezember 2010 noch bestand. Damit handelt es sich um einen reinen Inlandsfall. Auf die Verordnung (EG) Nr. 1393/2007 des Europäischen Parlaments und des Rates vom 13. November 2007 über die Zustellung gerichtlicher und außergerichtlicher Schriftstücke in Zivil- oder Handelssachen in den Mitgliedstaaten (ABl EU Nr. L 324 vom 10. Dezember 2007, S. 79), welche die Übermittlung von Schriftstücken in einen anderen Mitgliedstaat zum Gegenstand hat (vgl. Art. 1 Abs. 1 der Verordnung), kommt es nicht an.

3 Verfahrensgrundrechte der Beklagten wurden nicht verletzt. Insbesondere hatte die Beklagte, wie sich aus ihrem Faxschreiben vom 13. Januar 2011 ergibt, Kenntnis von den Zustellungen unter der Anschrift B. straße in W. . Die Zustellung des Versäumnisurteils am 16. Dezember 2010 wurde nicht dadurch unwirksam, dass die Beklagte - wie sie selbst vorgetragen hat - ihre Haushälterin anwies, den Briefumschlag mit dem Versäumnisurteil ungeöffnet an das Landgericht zurückzuschicken.

4 Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbsatz 2 ZPO abgesehen.
