Tenor

Der Antrag der Klägerin auf Beiordnung der Rechtsanwaltskanzlei S. GmbH Rechtsanwaltsgesellschaft Wirtschaftsprüfergesellschaft, , für das Vorabentscheidungsverfahren vor dem Gerichtshof der Europäischen Union wird abgelehnt.

Gründe

1 Mit Senatsbeschluss vom 9. April 2013 ist der Klägerin Prozesskostenhilfe für das Revisionsverfahren bewilligt und Rechtsanwalt Dr. N. beigeordnet worden. Die Bewilligung umfasst die Vertretung im Vorabentscheidungsverfahren vor dem Gerichtshof der Europäischen Union. Einen wichtigen Grund für die Entpflichtung von Rechtsanwalt Dr. N. für dieses Zwischenverfahren hat die Klägerin nicht dargelegt. Dass es zu einer Vorlage an den Gerichtshof der Europäischen Union kommen könnte, war von vorneherein bereits bei Beiordnung von Rechtsanwalt Dr. N. absehbar. Eine solche Vorlage war schon von den Vorinstanzen erörtert worden. Beide Gerichte hatten hiervon nur deshalb abgesehen, weil sie nicht vorlagepflichtig sind. Die Revisionsbegründung befasst sich hiermit ausführlich, wenn auch nur hilfsweise. Rechtsanwalt Dr. N. hat sich in der Revisionserwiderung ebenfalls bereits mit der Problematik befasst. Zweifel daran, dass Rechtsanwalt Dr. N. die Klägerin im Verfahren vor dem Gerichtshof der Europäischen Union ordnungsgemäß vertreten würde, sind weder dargetan noch ersichtlich. Dieser Anwalt genießt nach dem Antrag auch weiterhin das Vertrauen der Klägerin. Ein Anwaltswechsel für das Zwischenverfahren vor dem Gerichtshof der Europäischen Union ist deshalb nicht veranlasst.
