Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem Beschluss des Oberlandesgerichts München - 13. Zivilsenat - vom 16. Januar 2013 - 13 U 4211/12 - wird zurückgewiesen.

Der Kläger hat die Kosten des Beschwerdeverfahrens zu tragen.

Gründe

1 Die Rechtssache hat weder grundsätzliche Bedeutung (§ 543 Abs. 2 Satz 1 Nr. 1 ZPO) noch ist eine Entscheidung des Revisionsgerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung erforderlich (§ 543 Abs. 2 Satz 1 Nr. 2 ZPO).

2 Insbesondere ist die von der Beschwerde als rechtsgrundsätzlich aufgeworfene Frage, ob Ansprüche aus einem Vertragsverhältnis, aufgrund dessen ein Steuerberater als Mittelverwendungskontrolleur tätig wird, der Verjährung nach § 68 StBerG a.F. unterliegen, bereits zum Nachteil des Klägers geklärt. In seinem Urteil vom 11. Oktober 2001 (III ZR 288/00, WM 2262, 2264) hat der Senat ausgeführt, Schadensersatzansprüche gegen einen Steuerberater aus einem Treuhandvertrag verjährten gemäß § 68 StBerG (a.F.) innerhalb von drei Jahren. Der Mittelverwendungskontrolleur übt eine treuhänderische Tätigkeit (§ 57 Abs. 3 Nr. 3 StBerG) aus (BFH, Beschluss vom 3. Oktober 1985 - V B 88/84, juris Rn. 23). Auch in dem vom Senat seinerzeit entschiedenen Fall oblag es dem Steuerberater, die Freigabe von Kapital zu kontrollieren und diese nur unter bestimmten Voraussetzungen zu erklären (siehe aaO S. 2262).

3 Die von der Beschwerde angeführte Entscheidung des Bundesfinanzhofs vom 3. Oktober 1985 (aaO) stellt nicht in Frage, dass Schadensersatzansprüche gegen Steuerberater wegen Verletzung von Pflichten aus einem Mittelverwendungskontrollvertrag nach § 68 StBerG a.F. verjähren. Dass die Mittelverwendungskontrolle - unter dem Blickwinkel des Umsatzsteuerrechts - keine steuerberatende Tätigkeit im Sinne des § 33 StBerG darstellt, bedeutet nicht, dass sie aus dem Anwendungsbereich des § 68 StBerG a.F. herausfällt. Dieser Bestimmung unterliegen, wie sich bereits aus ihrem Wortlaut ergibt, nicht nur Schadensersatzansprüche wegen steuerberatender Tätigkeiten nach § 33 StBerG, sondern auch solche aus sämtlichen anderen vom Steuerberatungsgesetz gedeckten Verträgen (Gräfe/Lenzen/Schmeer, Steuerberaterhaftung, 4. Aufl., Rn. 858, 860; Kuhls in Kuhls/Meurers/Maxl/Schäfer/Goez/Willerscheid, Steuerberatungsgesetz, 2. Aufl., § 68 Rn. 2), zu denen auch diejenigen gehören, die eine der treuhänderischen Tätigkeit zuzuordnende Mittelverwendungskontrolle zum Gegenstand haben.

4 Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 1, 2. Halbsatz ZPO abgesehen.
