Tenor

Der Antrag des Klägers auf Zulassung der Berufung gegen das dem Kläger am 3. Mai 2013 zugestellte Urteil des I. Senats des Anwaltsgerichtshofes Baden-Württemberg wird abgelehnt.

Der Kläger hat die Kosten des Zulassungsverfahrens zu tragen.

Der Streitwert für das Zulassungsverfahren wird auf 5.000 € festgesetzt.

Gründe

1 Der Kläger beantragte durch Schriftsatz vom 9. Februar 2012, auf die Tagesordnung der nächsten Kammerversammlung am 29. März 2012 Beschlussanträge zu setzen, dass der Vorstand beauftragt werde, "in rechtlich zweifelhaften, untypisch, oder grotesk verlaufenden Verfahren vor allen Gerichtsbarkeiten, auf Anregung eines, an einem solchen Verfahren beteiligten Kammermitgliedes, einen offiziellen Prozessbeobachter zu bestellen, …" und "nach Auswertung des entsprechenden Berichtes auf allen gebotenen Wegen auf eine verfassungskonforme Justizpraxis hinzuwirken …". Mit Schriftsatz vom 10. Februar 2012 beantragte er weiterhin einen Beschlussantrag auf die Tagesordnung zu setzen, dass der Vorstand beauftragt werde, eine Presseabteilung einzurichten und eine Gerichtsreporter-Abteilung aus Anwälten einzurichten. Die Beklagte wies die Anträge durch Schreiben vom 6. März 2012 zurück. Der Anwaltsgerichtshof hat die Klage auf Aufnahme der leicht modifizierten Anträge auf die Tagesordnung der nächsten Kammerversammlung abgewiesen. Hiergegen richtet sich der Antrag des Klägers auf Zulassung der Berufung.

2 Der Antrag auf Zulassung der Berufung ist gemäß § 112e Satz 2 BRAO, § 124a Abs. 4 VwGO statthaft. Er bleibt jedoch ohne Erfolg.

3 1. Ernstliche Zweifel an der Richtigkeit des angefochtenen Urteils (§ 112e Satz 2 BRAO, § 124 Abs. 2 Nr. 1 VwGO) bestehen nicht.

4 Der Anwaltsgerichtshof hat den Kreis der den Rechtsanwaltskammern zugewiesenen Aufgaben nicht verkannt. Auch wenn in dem Urteil ausdrücklich nur § 89 Abs. 2 BRAO erwähnt wird, zeigt die Auseinandersetzung mit der Frage, ob es sich bei den angestrebten Tagesordnungspunkten um eine Angelegenheit "von allgemeiner Bedeutung für die Rechtsanwaltschaft" (§ 89 Abs. 1 Satz 2 BRAO) handelt, dass er den durch die §§ 73, 89 BRAO umrissenen Aufgabenbereich der Rechtsanwaltskammern insgesamt im Auge gehabt hat.

5 Der Anwaltsgerichtshof hat auch zu Recht entschieden, dass die vom Kläger begehrten Maßnahmen nicht vom Funktionsbereich der Rechtsanwaltskammern umfasst werden. Zwar ist Öffentlichkeitsarbeit im Grundsatz eine legitime Aufgabe der Rechtsanwaltskammern, soweit sie die Stellung der Anwaltschaft als Teil der Rechtspflege und des Selbstverständnisses anwaltlicher Tätigkeit betrifft (vgl. Hessischer AGH, BRAK-Mitt. 2008, 29; AGH Bremen, BRAK-Mitt. 1996, 86). Die vom Kläger angestrebten Maßnahmen sollen jedoch nicht den Belangen der Rechtsanwaltschaft insgesamt dienen, sondern zu einer Kontrolle der Justiz in Einzelfällen führen. Eine solche Kontrolle der Justiz gehört nicht zu den Aufgaben der Rechtsanwaltskammern.

6 2. Die Kostenentscheidung beruht auf § 112c Abs. 1 Satz 1 BRAO i.V.m. § 154 Abs. 2 VwGO, die Streitwertfestsetzung auf § 194 Abs. 1 BRAO, § 52 Abs. 2 GKG.
