Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Ravensburg vom 26. Oktober 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Die vom Tatgericht getroffenen Feststellungen tragen unter Berücksichtigung des Gesamtzusammenhangs des Urteils für den konkreten Einzelfall auch die Verurteilung wegen vollendeter gefährlicher Körperverletzung gemäß § 224 Abs. 1 Nr. 5 StGB. Für die Körperverletzung mittels einer das Leben gefährdenden Behandlung kommt es darauf an, dass die Körperverletzungshandlung unter den konkreten Umständen generell geeignet ist, den Tod des Opfers herbeizuführen (BGH, Urteile vom 4. September 1996 - 2 StR 320/96, BGHR StGB § 223a Abs. 1 Lebensgefährdung 8 und vom 13. Januar 2006 - 2 StR 463/05; siehe auch Hardtung, in Münchener Kommentar zum StGB, 2. Aufl., § 224 Rn. 38). Besteht die Tathandlung im Würgen des Tatopfers oder in anderen Formen der Einwirkung auf dessen Fähigkeit zu atmen, kommt es für das Vorliegen des Qualifikationsmerkmals auf die Dauer und Stärke der Einwirkung an (etwa BGH, Urteil vom 31. Mai 2002 - 2 StR 73/02, StV 2002, 649, 650).

Nach den Feststellungen des Landgerichts und seinen Ausführungen in der Beweiswürdigung hat sich der über 100 kg schwere Angeklagte rittlings im Rippen- und Bauchbereich seiner Frau, der Nebenklägerin, auf diese gesetzt und ihr zugleich seine linke Hand so auf Mund und Nase gepresst, dass diese keine Luft mehr bekam. Aus den vom Tatgericht mitgeteilten und von ihm dem Urteil zugrunde gelegten Ausführungen des rechtsmedizinischen Sachverständigen ergibt sich, dass durch das beschriebene Aufsitzen des Angeklagten die Rippen seiner Ehefrau nach oben geschoben wurden sowie aufgrund der dadurch bewirkten Kompression des Brustkorbs zusätzlich zu dem Verschließen von Mund und Nase eine gefährliche Einschränkung der Atmung herbeigeführt wurde. Das Zusammenwirken beider Einwirkungen des Angeklagten (zum Zusammenwirken von Würgen und gleichzeitigem Drehen des Kopfes zum Boden, das zu einer weiteren Beeinträchtigung der Atemluftzufuhr führt vgl. BGH, Urteil vom 31. Mai 2002 - 2 StR 73/02, StV 2002, 649, 650) erweist sich daher unter den besonderen Umständen des Einzelfalls als eine das Leben gefährdende Behandlung. Der bereits eingetretenen Vollendung des Qualifikationsmerkmals stand das im Ergebnis erfolgreiche Eingreifen des Sohnes der Nebenklägerin zu ihren Gunsten nicht entgegen.
