Die Beschwerde des Beklagten gegen die Nichtzulassung der Revision in dem Urteil des 20. Zivilsenats des Kammergerichts vom 29. März 2012 wird zurückgewiesen. Die Rechtssache hat weder grundsätzliche Bedeutung noch erfordert die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts (§ 543 Abs. 2 Satz 1 ZPO).

Die Sache ist auf der Grundlage der Senatsrechtsprechung (Urteil vom 26. Februar 1953 - IV ZR 207/52, DNotZ 1955, 406) richtig entschieden. Zu einer Korrektur dieser Rechtsprechung, die in der Literatur weitestgehend Zustimmung erfahren hat (statt aller: MünchKomm-BGB/Ann, 5. Aufl. § 2042 Rn. 5 und Soergel/Manfred Wolf, BGB 13. Aufl. § 2042 Rn. 36, jeweils m.w.N.), besteht - worauf bereits das Berufungsgericht zutreffend hingewiesen hat - auch in Ansehung der von der Beschwerde in Bezug genommenen neueren kritischen Auseinandersetzung (Eberl-Borges, Die Erbauseinandersetzung 2000) kein Anlass. Insbesondere wird dabei nicht hinreichend berücksichtigt, dass in diesen Fällen über den Rückgewähranspruch gemäß § 346 BGB als sogenanntes Beziehungssurrogat gemäß § 2041 BGB eine Auseinandersetzung nicht stattgefunden hat, mithin eine vollständige Verteilung aller Nachlassgegenstände, die zum Erlöschen einer Erbengemeinschaft führt, nicht erfolgt ist. Daran ist uneingeschränkt festzuhalten.

Der Senat hat auch die Gehörsrügen (Art. 103 Abs. 1 GG) geprüft und für nicht durchgreifend erachtet.

Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbsatz 2 ZPO abgesehen.

Der Beklagte trägt die Kosten des Beschwerdeverfahren (§ 97 Abs. 1 ZPO).
