Tenor

Das Ablehnungsgesuch des Betroffenen vom 22. Juli 2012 und die Anhörungsrüge gegen den Senatsbeschluss vom 27. Juni 2012 werden verworfen.

Der Antrag der Beteiligten zu 2 auf Bestellung eines Notanwalts wird abgelehnt.

Die Rechtsbeschwerde des Betroffenen gegen den Beschluss der 4. Zivilkammer des Landgerichts Bonn vom 13. Dezember 2011 wird verworfen.

Das Verfahren der Rechtsbeschwerde ist gerichtsgebührenfrei (§ 131 Abs. 5 Satz 2 KostO).

Gründe

1 1. Das Ablehnungsgesuch des Betroffenen ist rechtsmissbräuchlich und damit unzulässig. Bei der Ablehnung eines Richters müssen ernsthafte Umstände angeführt werden, die die Befangenheit des einzelnen Richters aus Gründen rechtfertigen, die in persönlichen Beziehungen dieses Richters zu den Parteien oder zu der zur Verhandlung stehenden Streitsache stehen (BGH Beschluss vom 28. Juli 2008 - AnwZ(B) 79/06 - juris Rn. 3 mwN). Solche Umstände legt der Betroffene nicht dar. Er hält die Entscheidungen des Vorsitzenden zwar für rechtswidrig bzw. willkürlich. Dieser Vortrag genügt jedoch nicht, um einen Befangenheitsgrund glaubhaft zu machen. Über das unzulässige Ablehnungsgesuch entscheidet der Senat in der regulären Besetzung und nicht ohne die abgelehnten Mitglieder (vgl. BGH Beschluss vom 14. April 2005 - V ZB 7/05 - NJW RR 2005, 1226, 1227).

2 2. Die Anhörungsrüge, die sich gegen die Ablehnung der Bestellung eines Notanwalts richtet und daher ebenfalls nicht dem Anwaltszwang unterliegt, ist wegen Fristversäumnis unzulässig. Sie ist nicht innerhalb der Zweiwochenfrist nach § 44 Abs. 2 Satz 1 FamFG eingelegt worden. Der Senatsbeschluss vom 27. Juni 2012 ist am 29. Juni 2012 formlos an den Betroffenen herausgegeben worden. Nach § 15 Abs. 2 Satz 1 FamFG gilt der Beschluss drei Tage nach Aufgabe zur Post als bekanntgegeben. Die Zweiwochenfrist begann daher am 3. Juli 2012 und endete mit Ablauf des 17. Juli 2012. Die Anhörungsrüge ist aber erst am 23. Juli 2012, also verspätet, beim Bundesgerichtshof eingegangen.

3 3. Die Bestellung eines Notanwalts für die Beteiligte zu 2 gemäß § 10 Abs. 4 Satz 3 FamFG in Verbindung mit § 78 b ZPO ist abzulehnen, weil die beabsichtigte Rechtsverfolgung aussichtslos erscheint (vgl. BGH Beschluss vom 25. März 2003 - VI ZR 355/02 - NJW-RR 2003, 1074).

4 4. Die Rechtsbeschwerde des Betroffenen ist zu verwerfen, weil sie nicht innerhalb der Monatsfrist des § 71 Abs. 2 Satz 1 FamFG begründet worden ist.
