Der Senat beabsichtigt, die Revision der Beklagten gemäß § 552a ZPO zurückzuweisen.

Gründe

1 Ein Grund für die Zulassung der Revision liegt nicht vor (§ 552a Satz 1, § 543 Abs. 2 Satz 1 ZPO).

2 Die vom Berufungsgericht genannte Rechtsfrage ist nicht grundsätzlicher Natur. Die Frage, ob dem Vermieter umlagefähige Kosten für Modernisierungsmaßnahmen erst mit der Begleichung der ihm hierfür in Rechnung gestellten Bauleistungen entstehen, hat keine grundsätzliche Bedeutung, denn offensichtlich entstehen diese Kosten jedenfalls - in Form einer fälligen Verbindlichkeit gegenüber dem Bauunternehmer - mit der Ausstellung der Rechnung über die durchgeführten Arbeiten. Dass in der Rechtsprechung der Instanzgerichte hierzu abweichende Auffassungen vertreten werden, ist nicht ersichtlich. Die ganz herrschende Meinung in der Literatur lässt als Nachweis der entstandenen Kosten die Vorlage der Rechnungen ausreichen (Staudinger/Emmerich, BGB, Neubearb. 2011, § 559b Rn. 5; MünchKommBGB/Artz, 6. Aufl., § 559b Rn. 9; Bamberger/Roth/Ehlert, BGB, 2. Aufl., § 559b Rn.19; Schmidt-Futterer/Börstinghaus, Mietrecht, 10. Aufl., § 559b BGB Rn. 38 mwN). Die vereinzelt gebliebene abweichende Literaturmeinung (Kinne, ZMR 2001, 868, 869; Schach in Kinne/Schach/Bieber, Miet- und Mietprozessrecht, 6. Aufl., § 559b BGB Rn. 3), die Kosten entstünden dem Vermieter erst im Zeitpunkt des Mittelabflusses (Zahlung), verleiht der Frage kein grundsätzliches Gewicht.

3 2. Die Revision hat auch keine Aussicht auf Erfolg.

4 In der Revisionsinstanz ist zwischen den Parteien nur noch im Streit, ob das Mieterhöhungsverlangen der Klägerin vom 19. Dezember 2008 auch ohne Beifügung von Zahlungsnachweisen wirksam ist, obgleich die Klägerin dem Verlangen des Beklagten - der die Zahlung der ausgewiesenen Rechnungsbeträge durch den Vermieter ohne nähere Darlegung bestritten hat - auf Vorlage von Zahlungsbelegen nicht nachgekommen ist. Das Berufungsgericht hat dies rechtfehlerfrei bejaht.

5 Nach den Feststellungen des Berufungsgerichts hatte der Beklagte (unstreitig) Einsicht in die dem Erhöhungsverlangen zugrunde liegenden Rechnungen. Einwendungen, dass die in Rechnung gestellten Maßnahmen nicht durchgeführt worden wären, hat der Beklagte nicht vorgebracht. Übergangenen Sachvortrag hierzu zeigt die Revision nicht auf.

6 3. Es besteht Gelegenheit zur Stellungnahme binnen drei Wochen ab Zustellung dieses Beschlusses.
