Tenor

Der Antrag der Kläger auf Bewilligung von Prozesskostenhilfe für die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil der 2. Zivilkammer des Landgerichts Magdeburg vom 21. Dezember 2011 - 2 S 172/11 - wird abgelehnt.

Gründe

1 Prozesskostenhilfe kann nur gewährt werden, wenn die beabsichtigte Rechtsverfolgung hinreichende Aussicht auf Erfolg hat (§ 114 ZPO).

2 Die von den Antragstellern beabsichtigte Nichtzulassungsbeschwerde (§ 544 Abs. 1 Satz 1 ZPO) hat jedoch keine Erfolgsaussicht. Eine solche Beschwerde ist gemäß § 26 Nr. 8 EGZPO nur zulässig, wenn der Wert der mit der Revision geltend zu machenden Beschwer 20.000 € übersteigt. Dies ist hier nicht der Fall. Die Beschwer bemisst sich nach dem Interesse des Rechtsmittelklägers an der Abänderung der Entscheidung. Dieses Interesse ist unter wirtschaftlichen Gesichtspunkten zu bewerten (z.B. BGH, Beschlüsse vom 6. November 2008 - V ZR 48/08, BeckRS 2008, 24125 Rn. 2 und vom 24. November 1971 - VIII ZR 80/71, BGHZ 57, 301, 302 f jew. mwN), so dass es entgegen der Ansicht der Vertreterin der Kläger nicht auf die subjektiv empfundene "grundsätzliche Bedeutung und das grundsätzliche Interesse, welches die Kläger dauerhaft an einer gerichtlichen Entscheidung haben", ankommt. Ebenso ist das Interesse dritter Personen, die an dem Rechtsstreit nicht beteiligt sind, an einer höchstrichterlichen Entscheidung für die Beschwer der unterlegenen Partei nicht von Bedeutung.
