Nichteröffnung des Insolvenzverfahrens: Rechtsweg für Vergütungsansprüche des vorläufigen Insolvenzverwalters

Tenor

Die Rechtsbeschwerde gegen den Beschluss der Zivilkammer 26 des Landgerichts Hamburg vom 12. März 2010 wird auf Kosten des weiteren Beteiligten als unzulässig verworfen.

Der Gegenstandswert des Rechtsbeschwerdeverfahrens wird auf 1.368,50 € festgesetzt.

Gründe

1 Die statthafte Rechtsbeschwerde (§ 21 Abs. 2 Satz 1 Nr. 1, § 64 Abs. 3 InsO, Art. 103f EGInsO, § 574 Abs. 1 Satz 1 Nr. 1 ZPO) ist unzulässig, weil kein Zulässigkeitsgrund vorliegt. Weder hat die Sache grundsätzliche Bedeutung, noch erfordert die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Rechtsbeschwerdegerichts (§ 574 Abs. 2 ZPO).

2 Die von der Rechtsbeschwerde aufgeworfene Grundsatzfrage ist durch die Rechtsprechung des Senats geklärt. Ist das Insolvenzverfahren nicht eröffnet worden, kann die Vergütung des vorläufigen Verwalters vom Insolvenzgericht weder dem Grund noch der Höhe nach im Verfahren nach §§ 63, 64 InsO, §§ 8, 10, 11 InsVV festgesetzt werden. Der Verwalter ist in diesem Fall wegen seines Vergütungsanspruchs auf den ordentlichen Rechtsweg zu verweisen (BGH, Urteil vom 13. Dezember 2007 - IX ZR 196/06, BGHZ 175, 48 Rn. 28 ff mwN; Beschluss vom 3. Dezember 2009 - IX ZB 280/08, ZIP 2010, 89). Entsprechend ist das Beschwerdegericht verfahren.

3 Für Insolvenzeröffnungsverfahren, die vor dem 1. März 2012 beantragt worden sind, gibt die an dieser Rechtsprechung geäußerte Kritik dem Senat keine Veranlassung zur Änderung seiner Auffassung. Für Insolvenzeröffnungsverfahren, die ab dem 1. März 2012 beantragt werden, gilt § 26a InsO in der Fassung von Art. 1 Nr. 7 des Gesetzes zur weiteren Erleichterung der Sanierung von Unternehmen vom 7. Dezember 2011 (BGBl. I S. 2582). Eine Rückwirkung für nicht abgeschlossene Altfälle sieht diese gesetzliche Neuregelung nicht vor (vgl. Art. 103g EGInsO in der Fassung des Art. 3 dieses Gesetzes).

4 Die Verweisung des Gläubigers eines streitigen zivilrechtlichen Anspruchs auf den streitigen Zivilrechtsweg verletzt den Gläubiger nicht in seinen Grundrechten.

5 Von einer weiteren Begründung wird gemäß § 577 Abs. 6 Satz 3 ZPO, § 4 InsO abgesehen.
