Tenor

Der Antrag des Schuldners auf Bewilligung von Prozesskostenhilfe für das Verfahren der Rechtsbeschwerde gegen den Beschluss der 23. Zivilkammer des Landgerichts Bielefeld vom 24. Juni 2011 wird abgelehnt.

Gründe

1 Die Voraussetzungen für die Bewilligung von Prozesskostenhilfe liegen nicht vor. Die beabsichtigte Rechtsverfolgung bietet keine hinreichende Aussicht auf Erfolg (§ 4 InsO, § 114 Satz 1 ZPO), denn eine Rechtsbeschwerde wäre unzulässig (§ 574 Abs. 2 ZPO). Die Rechtssache weist weder grundsätzliche Bedeutung auf, noch ist eine Entscheidung des Rechtsbeschwerdegerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung erforderlich.

2 Die Ausführungen des Beschwerdegerichts zur Nachprüfbarkeit der Gruppenbildung im vorliegenden Verfahrensstadium stimmen mit der Senatsrechtsprechung überein (vgl. BGH, Beschluss vom 7. Juli 2005 - IX ZB 266/04, BGHZ 163, 344, 347). Die Annahme des Beschwerdegerichts, die Gläubiger der Gruppe drei würden durch den vom Schuldner vorgelegten Plan schlechter gestellt als bei Durchführung des Insolvenzverfahrens, ist eine überwiegend in den Verantwortungsbereich des Tatrichters fallende Prognoseentscheidung und kann im Rechtsbeschwerdeverfahren ohnehin nur eingeschränkt nachgeprüft werden (vgl. BGH, Beschluss vom 26. April 2007 - IX ZB 5/06, ZInsO 2007, 713 Rn. 8). Unter zulässigkeitsrelevanten Gesichtspunkten ist diese Bewertung im Hinblick auf die den Gläubigern zustehenden deliktischen Forderungen, denen jeweils Untreuehandlungen des Schuldners zugrunde liegen und die bei entsprechender Anmeldung zur Tabelle keiner Restschuldbefreiung zugänglich sind (§ 302 Nr. 1 InsO), nicht zu beanstanden.
