Gründe

1 Der Beschwerdeführer, der dem Rechtstreit auf Seiten des Klägers als Streithelfer beigetreten ist, hat beantragt festzustellen, dass ein zwischen dem Kläger und der Beklagten oder der Streithelferin abgeschlossener Vergleich nichtig ist. Wenn ein Dritter auf die Feststellung der Nichtigkeit eines zwischen anderen Personen abgeschlossenen Vertrags klagt, bestimmt sich der Wert nach dem Interesse des Dritten (Onderka in Schneider/Herget, Streitwert-Kommentar, 13. Aufl., Rn. 2338). Wenn der Dritte - wie hier der Streithelfer - bereits an einem Rechtsstreit beteiligt ist, gilt nichts anderes. Von den zwischen Kläger und Beklagten noch im Streit befindlichen 14.641.194,49 € entfallen auf das Interesse des Streithelfers 2.636.879,12 €. Das Interesse des Streithelfers bestand hier nach seinen eigenen Angaben in der Beeinträchtigung der Feststellung seiner Ansprüche in Höhe von rund 70.000.000 € zur Insolvenztabelle. Bei Gläubigerforderungen von - laut Klage - insgesamt 388.553.440,20 € (759.944.475,95 DM) entfallen 18,01 % auf den Streithelfer.
