Omnilex summary

The Bundesgerichtshof rejected the applicant's reconsideration (Gegenvorstellung) against the order of 29 July 2011 that had dismissed his hearing complaint. The Senate held that the submission gave no reason to change the prior decision and that the applicant's compensation argument had already been considered but was not persuasive.

Omnilex headnote

Gegenvorstellung against an order dismissing an Anhörungsrüge; reconsideration is unsuccessful where the court has already considered the decisive argument and finds no basis for altering its prior decision. A mere repetition or recharacterization of submissions, including an argument of compensation, does not compel amendment of the earlier order (consid. 1).

Entscheidungsdatum: 2011-09-07

Aktenzeichen: V ZA 35/10

Dokumenttyp: Beschluss

Vorinstanz: vorgehend BGH, 29. Juli 2011, Az: V ZA 35/10, Beschlussvorgehend BGH, 19. Mai 2011, Az: V ZA 35/10, Beschlussvorgehend OLG München, 26. Oktober 2010, Az: 5 U 2320/10vorgehend LG München I, 4. März 2010, Az: 22 O 21972/99

Spruchkörper: 5. Zivilsenat

Tenor

Key legal question

Whether the applicant's reconsideration of the order denying his hearing complaint warranted amendment of the prior decision.

Extracted holding

The reconsideration presented no grounds for altering the prior order; the applicant's compensation argument had already been considered and found unpersuasive.

Extracted reasoning

The Senate stated that it had taken the applicant's compensation argument into account when deciding the hearing complaint, but it was not convincing and therefore did not justify a different outcome.
