Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts München I vom 26. November 2010 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Es ist aus Rechtsgründen nicht zu beanstanden, dass das Landgericht, das den Angeklagten u.a. wegen Vorenthaltens von Arbeitsentgelt (§ 266a StGB) verurteilt hat, die Höhe des an Arbeitnehmer ausbezahlten (Teil) Schwarzlohns geschätzt und hierbei einen Betrag von 66% der nicht mit Subunternehmern erzielten Nettoausgangsumsätze zu Grunde gelegt hat (zur Zulässigkeit einer solchen Schätzung vgl. BGH, Urteil vom 2. Dezember 2008 - 1 StR 416/08, NJW 2009, 528, 529; BGH, Beschluss vom 10. November 2009 - 1 StR 283/09, NStZ 2010, 635, 636). Die Strafkammer hat jedoch - worauf der Generalbundesanwalt zutreffend hinweist - bei der Bestimmung der Höhe der in den Monaten ab August 2002 vorenthaltenen Sozialversicherungsbeiträge § 14 Abs. 2 Satz 2 SGB IV außer Acht gelassen. Dies ist nach der Rechtsprechung des Bundesgerichtshofs rechtsfehlerhaft: Gemäß § 14 Abs. 2 Satz 2 SGB IV, mit der dem Phänomen der illegalen Beschäftigung entgegengewirkt werden soll (vgl. BT-Drucks. 15/726, S. 3f.), ist in Fällen hier vorliegender illegaler Beschäftigung stets von einer Nettolohnvereinbarung auszugehen, auch wenn dies zu einem Bruttoarbeitsentgelt führen kann, das den Wert der Arbeitsleistung übersteigt (BGH, Beschluss vom 10. November 2009 - 1 StR 283/09, aaO; a.A. Trüg, DStR 2011, 727, 729, unter unzutreffendem Hinweis auf den Zweifelssatz, der indes keine Beweis- sondern eine Entscheidungsregel ist; vgl. BGH, Urteil vom 21. Oktober 2008 - 1 StR 292/08, NStZ-RR 2009, 90). Hierdurch ist der Angeklagte indes nicht beschwert.
