The BGH rejected the defendant’s revision as unfounded, but corrected the conviction. The defendant had threatened and beaten the victim to obtain payment of a nonexistent debt or drugs and then forced him to hand over new sneakers as collateral. The court held that obtaining collateral for a non-existent claim constitutes completed especially serious robbery extortion, not merely attempted coercion/extortion. The sentence imposed by the Landgericht Düsseldorf was left unchanged, despite the defendant’s argument that a hardship adjustment should have been made for a fully served prior sentence.
§§ 255, 250 Abs. 2 Nr. 1 StGB; forcing surrender of collateral for a non-existent claim constitutes completed especially serious robbery extortion and not merely attempted coercion/extortion. Whoever, by threat or violence, compels the transfer of a pledged item in order to secure an unreal or non-existent claim obtains immediately a pecuniary advantage equivalent to the loss of possession; the offense is therefore completed upon surrender of the object (consid. 1). By contrast, where a claim exists or is at least believed to exist, the assessment may differ. A correction of the conviction does not violate § 265 StPO if the accused could not have defended differently. A hardship adjustment in sentencing need not be granted where the appellate court can exclude that a lower sentence would have been imposed even if the adjustment and other sentencing modifications had been considered (consid. 2).

Erpressung: Erzwingung der Herausgabe eines Pfandgegenstandes bei nicht bestehender Forderung
Die Revision des Angeklagten gegen das Urteil des Landgerichts Düsseldorf vom 16. November 2010 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO);
jedoch wird das vorbezeichnete Urteil, soweit es den Angeklagten betrifft, im Schuldspruch dahin abgeändert, dass der Angeklagte der besonders schweren räuberischen Erpressung in Tateinheit mit vorsätzlicher Körperverletzung schuldig ist.
Ergänzend zur Antragsschrift des Generalbundesanwalts bemerkt der Senat:
Der Senat ändert den Schuldspruch entsprechend ab. § 265 StPO steht dem nicht entgegen, denn der Angeklagte hätte sich bei zutreffender rechtlicher Bewertung der Tat nicht anders verteidigen können.
