BGH VII ZR 94/09Bgh / Civil Chamber 7May 19, 2011Dismissed

Omnilex summary

The Federal Court dismissed the plaintiff's complaint against denial of leave to appeal. It noted that the appellate court's reasoning on the start of limitation for damages under the old architect-contract liability rules and on the applicability of § 634a BGB was legally incorrect in light of later case law, but this did not matter because the appellate judgment was also independently based on forfeiture. As that alternative reasoning was sufficient, no leave to appeal was warranted. The plaintiff was ordered to bear the costs of the complaint proceedings.

Omnilex headnote

§ 544 Abs. 4 Satz 2 ZPO; leave to appeal against denial of revision is not granted where the challenged judgment is sustained by an independent, legally unobjectionable alternative ground. Errors in one line of reasoning do not justify admission if they are not decisive for the outcome. Forfeiture may constitute such an autonomous ground; if it supports the judgment, the admissibility requirement is not met merely because another supporting reason is erroneous (cf. consid. related).

Tenor

Halbsatz ZPO).

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Key legal question

Whether leave to appeal should be granted despite alleged errors on limitation law under § 635 BGB a.F. and § 634a BGB.

Extracted holding

No. Although the appellate court's limitation reasoning was legally flawed, that point was not decisive because the judgment was independently supported by its forfeiture reasoning.

Extracted reasoning

The Federal Court referred to later case law clarifying the limitation issues, but held that these errors did not justify leave to appeal since the appellate judgment stood on additional independent grounds.
