Sachverständigenvergütung im Patentnichtigkeitsverfahren: Erstattungsfähigkeit von Reise- und Hotelkosten sowie eines Tagegeldes
Die Vergütung des gerichtlichen Sachverständigen für Übernachtung und Tagegeld wird unter Zurückweisung seines weitergehenden Antrags auf 72 EUR einschließlich Umsatzsteuer festgesetzt.
1 Der gerichtliche Sachverständige hat mit Schreiben vom 28. Januar 2011 die Kosten für die Übernachtung vom 19. auf den 20. Mai 2010 belegt. Die Hotelrechnung beinhaltet Übernachtungskosten in Höhe von 66 EUR sowie 6 EUR für das Frühstück. Erstattungsfähig sind nur die reinen Übernachtungskosten (Hartmann, Kostengesetze, 41. Aufl., JVEG § 6 Rn. 5 bis 8). Für den Anreisetag steht dem Sachverständigen außerdem über das bereits gewährte Tagegeld hinaus ein Tagegeld von 6 EUR zu (§ 6 JVEG i.V.m. § 4 Buchst. c) EStG).
