Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Bremen vom 6. August 2010 wird nach § 349 Abs. 2 StPO mit der Maßgabe (§ 349 Abs. 4 StPO) als unbegründet verworfen, dass fünf Monate Freiheitsstrafe als vollstreckt gelten.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dadurch dem Nebenkläger entstandenen notwendigen Auslagen zu tragen.

Das Landgericht hat bei seiner Kompensationsentscheidung nicht ausreichend berücksichtigt, dass der Angeklagte vom 15. Februar 2006 bis zum 8. November 2007 erhebliche Meldeauflagen erfüllte (vgl. BVerfG – Kammer – NJW 2006, 668, 669). Dies korrigiert der Senat entsprechend § 354 Abs. 1 StPO.
