Omnilex summary

The Federal Court refused the applicant legal aid for an intended extraordinary complaint against a Hamburg Higher Regional Court order and a later letter from the presiding judge. It held that the proposed remedy had no sufficient prospects of success because an extraordinary complaint for manifest unlawfulness or violation of procedural fundamental rights is no longer admissible. The Federal Court may be seized only in the cases exhaustively listed in Art. 574(1) ZPO, and those conditions were not met because no statutory opening existed and no leave had been granted by the lower court.

Omnilex headnote

§ 574 Abs. 1 ZPO; extraordinary complaint to the Federal Court only in the cases exhaustively provided by statute; an extraordinary complaint based on manifest unlawfulness or violation of procedural fundamental rights is inadmissible under the reformed civil procedure system. For legal aid under § 114 Satz 1 ZPO, the intended proceeding must offer sufficient prospects of success; where the sought remedy is not statutorily available, legal aid is to be refused. The Federal Court may not entertain an appeal outside the channels of Art. 574(1) ZPO, whether or not the party alleges grievous legal error (consid. 1).

Key legal question

Whether legal aid should be granted for the intended extraordinary complaint to the Federal Court.

Extracted holding

Legal aid was refused because the intended appeal had no sufficient prospect of success.

Extracted reasoning

The extraordinary complaint is no longer admissible under the revised complaint system; the Federal Court may be seized only under Art. 574(1) ZPO, and the conditions for legal complaint were not met because the complaint was neither generally opened by law nor admitted by the lower court.

Key legal question

Whether an extraordinary complaint for manifest unlawfulness or violation of procedural fundamental rights is admissible.

Extracted holding

No; such extraordinary complaint is not admissible after the reform of the civil procedure rules.

Extracted reasoning

The court reiterated that the Federal Court can be appealed to exclusively in the cases of Art. 574(1) ZPO, so an extraordinary complaint based on manifest unlawfulness or procedural fundamental rights is no longer available.
