Tenor

Die Urteile des Amtsgerichts Brühl vom 30. Juni 2009 und der 13. Zivilkammer des Landgerichts Köln vom 9. Dezember 2009 werden auf die Rechtsmittel des Klägers aufgehoben.

Die Beklagte wird verurteilt, an den Kläger 2.037,90 € nebst Zinsen in Höhe von 8 Prozentpunkten über dem Basiszinssatz seit dem 1. Mai 2008 zu zahlen.

Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Tatbestand

1 Der Kläger ist Verwalter in dem Insolvenzverfahren über das Vermögen des J. D. (fortan: Schuldner). Der Schuldner bezahlte nach Stellung des Eröffnungsantrags durch die Beklagte, eine gesetzliche Krankenversicherung, an diese Sozialversicherungsbeiträge in Höhe von insgesamt 4.300 €. Nach Anfechtung dieser Zahlung blieb die Beklagte der Masse 2.037,90 € schuldig. Sie meinte, insoweit müsse sie die Arbeitnehmeranteile zur Sozialversicherung aufgrund der Neuregelung des § 28e Abs. 1 Satz 2 SGB IV nicht zurückzahlen.

2 Das Amtsgericht hat die Klage auf Rückzahlung der 2.037,90 € an die Masse abgewiesen. Das Berufungsgericht, dessen Entscheidung in ZIP 2010, 41, ZInsO 2010, 427, NZG 2010, 512 veröffentlich ist, hat die Berufung des Klägers in Kenntnis der Entscheidung des Senats vom 5. November 2009 (IX ZR 233/08, BGHZ 183, 86) zurückgewiesen. Mit der vom Berufungsgericht zugelassenen Revision verfolgt der Kläger seinen Zahlungsanspruch weiter.

Entscheidungsgründe

3 Die Revision ist begründet.

Zahlungen der Arbeitnehmer auf Gesamtsozialversicherungsbeiträge können ungeachtet der Regelung des § 28e Abs. 1 Satz 2 SGB IV als Rechtshandlung des Arbeitgebers im Insolvenzverfahren über dessen Vermögen als mittelbare Zuwendung an die Einzugsstelle angefochten werden (BGHZ 183, 86 Rn. 13). § 28e Abs. 1 Satz 2 SGB IV steht der Annahme einer Gläubigerbenachteiligung im Sinne des § 129 Abs. 1 InsO nicht entgegen. Die Ausführungen des Berufungsgerichts geben mangels neuer Argumente keine Veranlassung, die Rechtsfrage anders zu entscheiden.

5 2. Der Senat kann die Sache selbst entscheiden (§ 563 Abs. 3 ZPO). Die Aufhebung des Urteils erfolgt wegen Rechtsverletzung bei Anwendung des Gesetzes auf das festgestellte Sachverhältnis. Die Sache ist zur Endentscheidung reif. Die Voraussetzungen des § 130 Abs. 1 Nr. 2 InsO sind offensichtlich gegeben. Die Beklagte selbst hat den für die Verfahrenseröffnung maßgeblichen Insolvenzantrag gestellt.
