Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil des 6. Zivilsenats des Brandenburgischen Oberlandesgerichts vom 31. März 2009 wird zurückgewiesen, weil keiner der im Gesetz (§ 543 Abs. 2 ZPO) vorgesehenen Gründe vorliegt, nach denen der Senat die Revision zulassen darf. Der Rechtsstreit der Parteien hat weder grundsätzliche Bedeutung, noch erfordert er eine Entscheidung des Revisionsgerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung. Der Senat hat die Verfahrensrügen geprüft und für nicht durchgreifend erachtet.

Der Beklagte kann im Hinblick auf das Berufungsurteil die Rückzahlung des Darlehens nicht auf Dauer verweigern. Er muss sich vielmehr um eine andere bezahlte Tätigkeit bemühen und/oder die Anfechtungsverfahren gegen die Thesaurierungsbeschlüsse fortsetzen bzw. durchführen; ggfl. hat er die aufgrund der Einziehung zu zahlende Abfindung zur Rückführung des Darlehens zu verwenden.

Von einer näheren Begründung wird gemäß § 544 Abs. 4 Satz 2, 2. Halbsatz ZPO abgesehen.

Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 ZPO).
