Das Rechtsmittel gegen den Beschluss des 21. Zivilsenats - Familiensenat - des Oberlandesgerichts Köln vom 10. Juni 2009 wird auf Kosten der Antragstellerin als unstatthaft verworfen.

Der Antrag, für die Durchführung dieses Rechtsmittels Prozesskostenhilfe zu gewähren, wird zurückgewiesen, weil die beabsichtigte Rechtsverfolgung keine Aussicht auf Erfolg hat.

Gründe

1 Auf das Rechtsmittel findet noch das bis zum 31. August 2009 geltende Verfahrensrecht Anwendung, weil das Verfahren vor dem 1. September 2009 eingeleitet worden ist (Art. 111 Abs. 1 FGG-RG; vgl. Senatsurteil vom 16. Dezember 2009 - XII ZR 50/08 - Tz. 7, zur Veröffentlichung in BGHZ bestimmt).

2 Das von der Antragstellerin als Rechtsbeschwerde bezeichnete Rechtsmittel ist nicht statthaft. Nach dem bis zum 31. August 2009 geltenden Verfahrensrecht ist eine Rechtsbeschwerde nicht zulässig, weil sich das Rechtsmittelverfahren gemäß § 40 Abs. 2 IntFamRVG (a.F.) nach § 22 FGG richtet und nach dem FGG nur die sofortige Beschwerde sowie die weitere Beschwerde (§ 27 FGG) vorgesehen sind (vgl. KG FamRZ 2009, 624). Nach der Sonderregelung in § 40 Abs. 2 Satz 3 IntFamRVG (a.F.) findet jedoch in Verfahren nach dem Haager Kindesentführungsübereinkommen (HKÜ) gegen Entscheidungen der Oberlandesgerichte eine weitere Beschwerde nicht statt. Die von der Antragstellerin angeführte Vorschrift (§ 28 IntFamRVG) betrifft nur die in Abschnitt 5 des IntFamRVG aufgeführten Verfahren, zu denen das Verfahren nach dem HKÜ (Abschnitt 6) nicht gehört.

3 Im Ergebnis gilt im Übrigen nach dem seit dem 1. September 2009 geltenden Verfahrensrecht nichts anderes (§ 40 Abs. 2 Satz 4 IntFamRVG n.F.).
