Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hamburg vom 17. September 2009 wird nach § 349 Abs. 2 StPO als unbegründet verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat zu den Verfahrensrügen 2 und 3:

Die Rüge, das Selbstleseverfahren sei unter Verstoß gegen § 249 Abs. 2, § 261 StPO durchgeführt worden, ist unzulässig (§ 344 Abs. 2 Satz 2 StPO). Die Revision bezeichnet die Urkunden, die den Verfahrensmangel begründen sollen, nicht hinreichend.

Die Verfahrensrüge, die auf dem - nicht verbeschiedenen - vor Eröffnung des Hauptverfahrens gestellten Antrag des Angeklagten auf Auswechselung des Pflichtverteidigers aufbaut, ist nach den Maßstäben von BGHR StPO § 218 Ladung 6 und § 24 Revision 1 unzulässig. Der hier vorliegende Fall, in dem der Angeklagte nach beantragtem Pflichtverteidigerwechsel in dem Hauptverhandlungstermin vom 14. September 2009 unter ausschließlicher Mitwirkung des bisherigen Pflichtverteidigers eine Verständigung im Sinne des § 257c Abs. 2 StPO getroffen hat, und die Nichtverbescheidung seines Antrags aus dem Zwischenverfahren gleichwohl mit der Revision rügt, ist nicht anders zu behandeln als das Beharren auf einer Verletzung von § 218 Satz 1 StPO oder § 24 Abs. 1 StPO nach einer wirksamen Verständigung. Ob Rechtsprechung des 3. Strafsenats (StV 2009, 628, 629) dem entgegen stünde, bedarf keiner Vertiefung. Die Rüge ist nämlich auch unbegründet. Im Abschluss einer Verständigung unter Mitwirkung des allein tätig gewordenen Pflichtverteidigers liegt eine wirksame konkludente Rücknahme des Antrags auf Auswechselung des Pflichtverteidigers (vgl. BGHR StPO § 218 Ladung 6).
