Die Anhörungsrüge der Klägerin gegen den Beschluss des Senats vom 26. Januar 2010 wird verworfen.

Die Klägerin trägt die Kosten des Verfahrens.

Gründe

1 Die Anhörungsrüge ist unzulässig. Dem Rügevorbringen ist nicht zu entnehmen, dass der Senat den Anspruch der Klägerin auf rechtliches Gehör in entscheidungserheblicher Weise verletzt hat. Die Rüge genügt damit nicht den gesetzlichen Darlegungserfordernissen (§ 152a Abs. 2 Satz 6 VwGO).

2 Aus dem auf die vorinstanzlichen Entscheidungen bezogenen Vorbringen ergibt sich die behauptete Verletzung des rechtlichen Gehörs schon deswegen nicht, weil diese Verfahrensgarantie die Gerichte zwar verpflichtet, das Vorgetragene zur Kenntnis zu nehmen und in Erwägung zu ziehen, ihnen aber nicht gebietet, bei der Würdigung des Prozessstoffs den Ansichten der Beteiligten zu folgen. Soweit die Klägerin behauptet, mit der Zurückweisung der Nichtzulassungsbeschwerde setze sich der - vermeintliche - Verstoß der Vorinstanzen gegen die Verfahrensgarantie fort, fehlt es überdies an der erforderlichen Darlegung, dass der Senat bei der Beurteilung der Voraussetzungen für eine Zulassung der Revision entscheidungserheblichen Vortrag der Klägerin in ihrer Nichtzulassungsbeschwerde nicht zur Kenntnis genommen oder in Erwägung gezogen hat.

3 Die Kostenentscheidung folgt aus § 154 Abs. 1 VwGO.
