Tenor

Das Rechtsmittel gegen den Beschluss des Oberlandesgerichts Frankfurt am Main - 5. Senat für Familiensachen - vom 23. Dezember 2009 wird als unzulässig verworfen. Gerichtskosten werden nicht erhoben (§ 2 FamGKG).

Gründe

1 Die vom Bezirksrevisor eingelegte - vom Beschwerdegericht zugelassene - Rechtsbeschwerde ist zwar statthaft; im Übrigen ist sie indessen unzulässig.

2 Es kann dahingestellt bleiben, ob der Bezirksrevisor gemäß §§ 10 Abs. 4 Satz 2, 114 Abs. 3 Satz 2 FamFG vor dem Bundesgerichtshof überhaupt postulationsfähig ist. Voraussetzung ist danach, dass die handelnde Person die Befähigung zum Richteramt hat. Ob der hier handelnde Bezirksrevisor Volljurist ist, lässt sich seiner Beschwerdeschrift nicht entnehmen; regelmäßig verfügen Bezirksrevisoren über die Ausbildung eines Rechtspflegers.

3 Jedenfalls ist die Rechtsbeschwerde deshalb unzulässig, weil sie entgegen § 71 Abs. 2 und Abs. 3 FamFG nicht ordnungsgemäß begründet ist. Der Verweis auf die sich aus dem Akteninhalt ergebenden Stellungnahmen vermag die erforderliche Begründung nicht zu ersetzen (vgl. BGH Urteil vom 24. Januar 2000 - II ZR 172/98 - NJW 2000, 1576 [Revisionsbegründung]; Keidel/Meyer-Holz FamFG 16. Aufl. § 71 Rdn. 36; Bork/Jacoby/Schwab/Müther FamFG § 71 Rdn. 20).
