Der Antrag des Klägers, ihm für seine Beschwerde gegen den Beschluss des Bayerischen Verwaltungsgerichtshofs vom 18. Januar 2010 Prozesskostenhilfe zu bewilligen und einen Rechtsanwalt beizuordnen, wird abgelehnt.

Gründe

1 Dem Kläger kann Prozesskostenhilfe nicht bewilligt und ein Rechtsanwalt nicht beigeordnet werden, weil die Beschwerde gegen den Beschluss des Bayerischen Verwaltungsgerichtshofs vom 18. Januar 2010 keine hinreichende Aussicht auf Erfolg bietet und aussichtslos erscheint (§ 166 VwGO i.V.m. § 114 Satz 1, § 121 Abs. 1 ZPO; § 173 VwGO i.V.m. § 78b Abs. 1 Satz 1 ZPO).

2 Die von dem Kläger gegen den Beschluss des Bayerischen Verwaltungsgerichtshofs eingelegte Beschwerde ist unzulässig, weil die Entscheidung des Bayerischen Verwaltungsgerichtshofs von Gesetzes wegen unanfechtbar ist (vgl. § 152 Abs. 1 VwGO).
