Der Beklagte wird verurteilt, an die Klägerin EUR 952,00 nebst Zinsen in Höhe von 9 Prozentpunkten über dem jeweiligen Basiszinssatz aus EUR 190,40 seit dem 07.06.2016, EUR 190,40 seit dem 07.07.2016, EUR 190,40 seit dem 07.08.2016, EUR 190,40 seit dem 07.09.2016, EUR 190,40 seit dem 07.010.2016 zu zahlen.
Der Beklagte wird verurteilt, die Klägerin von der Gebührenforderung ihrer Rechtsanwälte, der Kanzlei C & Kollegen, K-Straße - 20, D, in Höhe von EUR 124 freizustellen.
Im Übrigen wird die Klage abgewiesen.
Der Beklagte trägt die Kosten des Rechtsstreits mit Ausnahme der Kosten, die durch die Verweisung vom Amtsgericht Krefeld an das Amtsgericht Düsseldorf entstanden sind.
Das Urteil ist vorläufig vollstreckbar. Der Beklagte darf die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des auf Grund des Urteils vollstreckbaren Betrages abwenden, sofern nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
Dem Beklagten bleibt die Geltendmachung seiner Rechte im Nachverfahren vorbehalten.
