durch die Richterin am Amtsgericht E

für R e c h t erkannt:

Der in der Eigentümerversammlung vom 13.04.2016 unter TOP 3 Nr. 1 (Sondervergütung außerordentliche Eigentümerversammlung) gefasste Beschluss wird für ungültig erklärt.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 68 % und die Beklagten zu 32 %.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien wird nachgelassen, die Vollstreckung durch den jeweiligen Gegner durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abzuwenden, wenn nicht der Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.

Der Streitwert wird auf 3.063,50 EUR festgesetzt.
